Terms of Use
The short version: the music you make with DRUMKIT is yours, including anything you make from the sounds it generates. What you may not do is repackage those sounds and sell them as sounds.

Your license to the app
DRUMKIT is licensed to you, not sold. Buying it through the App Store gives you a personal, non-exclusive, non-transferable license to use it on devices you own or control, under Apple's standard end user license terms as well as these.
You may not resell, redistribute, rent, sublicense, or reverse-engineer the app itself, except where the law says you may regardless of what a contract states.
Your work is yours
NIGHTSHAPE claims no ownership of anything you make in DRUMKIT — your patterns, songs, kits, custom patches, mixes, and exports belong to you. We take no cut, require no credit, and do not need to be told what you release.
Sample license
This covers sounds DRUMKIT itself generates: Drum Synth renders and anything in a Sample Pack that originates from the app rather than from audio you supplied.
You may use, edit, layer, process, and synchronise them royalty-free in your own original music, recordings, performances, audiovisual works, games, films, broadcasts, and other finished productions — commercial work included.
You may not redistribute, share, upload, resell, sublicense, lease, lend, or otherwise make NIGHTSHAPE-generated sounds available as standalone audio, or as part of a sample pack, sound library, preset pack, template, sound-effect collection, or any competing product. The distinction is simple: sell the music, not the sounds.
Audio you import
DRUMKIT will slice and process whatever you give it. It cannot tell whether you have the right to use that material, and it makes no attempt to.
That responsibility is yours. You are confirming that you own the audio you import or otherwise have permission to use it, and you are responsible for any consequences of sampling material you do not have the rights to. Slicing someone else's recording in DRUMKIT does not create a right to release it.
Availability
We intend to keep improving DRUMKIT, but we do not promise any specific future feature, update, or release date, and features may change between versions. Nothing on this website is a contractual commitment to ship a particular thing.
No warranty
DRUMKIT is provided "as is", without warranty of any kind, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that it will be uninterrupted or error-free.
Keep backups of work that matters to you. As the Privacy Policy explains, your projects live on your device, so we cannot recover them if the device is lost, reset, or the app is deleted.
Limitation of liability
To the fullest extent the law allows, NIGHTSHAPE is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost work, or lost data arising from your use of DRUMKIT. Where liability cannot be excluded, it is limited to the amount you paid for the app.
Some jurisdictions do not allow these exclusions, so parts may not apply to you. Nothing here limits rights you have under consumer law that cannot be waived.
Refunds and support
Purchases and refunds are handled by Apple under the App Store's terms; we cannot issue refunds directly. For anything else, support@nightshape.net.
Changes
These terms may be updated; the revised version will be posted here with a new date. Continuing to use DRUMKIT after a change means you accept the updated terms.
